Terms of Service

1. Service Description
SA Picture Day (“we”, “us”) operates the Booksa booking portal, which allows parents and guardians to reserve photo session slots and purchase prepay credit packages for professional volume photography events. By completing a booking or purchase you agree to these terms.
2. School & Organization Relationship
SA Picture Day is an independent vendor contracted by schools, daycares, and other organizations to provide photography services. The hosting organization does not act as our agent and has no authority to make representations, commitments, or modifications to these terms on our behalf. Any promises or statements made by school or organization staff regarding pricing, refunds, scheduling, or delivery are not binding on SA Picture Day. 3. Electronic Acceptance
By completing a booking or purchase through this portal you are entering into a legally binding agreement and affixing your electronic signature in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act). You agree that electronic acceptance has the same legal effect as a handwritten signature.
4. Eligibility & Minors
By accepting these terms you confirm that you are at least 18 years of age and, where you are booking on behalf of a minor, that you are that child's parent or legal guardian with full authority to enter into this agreement on their behalf. You also expressly consent to your child being photographed at the booked event as part of the service.
5. Children's Privacy (COPPA)
SA Picture Day does not collect personal information directly from children. Information about minors (such as names and grade level) is submitted by parents or legal guardians only. By providing this information you confirm you are the child's parent or legal guardian and you are providing verifiable parental consent for us to process that information solely for the purpose of fulfilling your booking. We do not knowingly collect or retain personal data from children under 13 beyond what is necessary to complete the booked service. 6. Pricing
All prices are displayed in US Dollars. Sales tax is calculated and added at checkout based on your billing address where applicable.
Prices may change between events. The price displayed at checkout is the price you pay.
7. Payment Processing
Payments are processed by Stripe, Inc., a third-party payment processor. By completing a purchase you agree to Stripe's Terms of Service and Privacy Policy. SA Picture Day does not store your full card details — all payment data is handled directly by Stripe in accordance with PCI DSS standards.
8. Failed or Declined Payments
If your payment is declined or fails during checkout, any slot hold placed during the session will be released and your booking will not be confirmed. No credits will be issued. You may restart the booking process subject to slot availability at that time.
9. Technical Failures & System Availability
While we strive to maintain continuous availability of the Booksa booking portal, we do not guarantee uninterrupted access. In the event of a system outage, technical error, or double-booking caused by a platform failure, our sole liability is limited to refunding the amount paid for the directly affected booking. We are not liable for any lost opportunity, missed session, or consequential damages arising from a technical failure. If you experience a system error during booking, contact support@sapicture.day immediately and we will resolve it as promptly as possible.
10. Prepay Credits — How They Work
- Prepay credit codes are emailed to you after payment is confirmed (typically within 5 minutes).
- Each code must be applied in full in a single purchase — credits cannot be split across multiple orders.
- A single prepay code may cover multiple children in one order.
- Codes never expire.
- Codes are redeemed on the photo delivery platform when ordering prints and digital downloads.
11. Cancellation & Refund Policy
Prepay credits are non-refundable unless the photo shoot is cancelled by SA Picture Day or the hosting organization (e.g. the school or group that arranged the event), in which case a full refund will be issued to your original payment method within 5–10 business days.
If SA Picture Day reschedules a session, your prepay credits remain valid and will automatically apply to the rescheduled event. No refund is issued for rescheduled sessions.
12. No-Show Policy
If you book a time slot and do not attend your scheduled session, your prepay credits are forfeited. No refund or credit transfer will be issued for no-shows. It is your responsibility to attend the session at the date and time you selected.
13. Force Majeure
SA Picture Day shall not be liable for any failure or delay in performing services caused by circumstances beyond our reasonable control, including but not limited to severe weather, acts of God, natural disasters, venue closure, power outages, governmental actions, or public health emergencies. In such events, SA Picture Day reserves the right to close the event without prior notice.
Where a force majeure event results in a rescheduled session, your prepay credits will carry over and apply to the rescheduled event. Where rescheduling is not possible and the event is permanently cancelled, a full refund will be issued within 5–10 business days.
14. Chargebacks & Payment Disputes
If you initiate a chargeback or payment dispute with your bank or card issuer for a charge that was valid under these terms, you are in breach of this agreement. We reserve the right to contest any such dispute with full transaction records and booking evidence provided to Stripe and the relevant financial institution. Fraudulent chargebacks may result in your access to the service being suspended.
If you believe a charge was made in error, contact us at support@sapicture.day before initiating a dispute — we are committed to resolving legitimate issues directly and promptly.
15. Photography & Image Rights
All photographs taken at SA Picture Day events are the intellectual property of SA Picture Day. Upon purchase of a package, you receive a personal, non-commercial license to use, print, and share the images of your child(ren).
By booking a session you grant SA Picture Day a limited, royalty-free right to use representative event photos (not individually identified children) for portfolio and marketing purposes. If you do not consent to marketing use, notify us at support@sapicture.day before the event and we will exclude your images.
16. Photography Results
SA Picture Day provides professional volume photography services. However, final image quality and results may vary based on factors outside our control, including but not limited to a child's cooperation, movement, lighting conditions at the venue, attire, and available session time. We do not guarantee specific poses, expressions, or outcomes. Dissatisfaction with image quality resulting from these factors does not entitle you to a refund under the Texas Deceptive Trade Practices Act or any other basis.
17. Third-Party Platform Disclaimer
Prepay credits are redeemed on an independent third-party photo delivery platform. SA Picture Day is not responsible for that platform's availability, pricing, fulfillment timelines, data practices, or any disputes arising from its use. Your use of that platform is governed by its own terms of service and privacy policy.
18. Privacy & Data Collection
To fulfill your booking we collect names, email addresses, children's names, and payment information. This data is used solely to process your booking and deliver your order. 19. Accessibility
We are committed to making our booking portal accessible to all users. If you experience difficulty using this service due to a disability or require an accommodation to complete your booking, please contact us at support@sapicture.day or call 210-529-8090 and we will assist you directly.
20. Acceptable Use
You agree not to:
- Submit false or fraudulent booking information
- Attempt to manipulate, scrape, or abuse the booking system
- Resell or transfer prepay credits without our written consent
21. Indemnification
You agree to indemnify, defend, and hold harmless SA Picture Day and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these terms, your misuse of the service, or your violation of any applicable law.
22. Disclaimer of Warranties
The Booksa service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
23. Liability Limitation
To the maximum extent permitted by applicable law, SA Picture Day shall not be liable for any indirect, incidental, special, or consequential damages arising from use of this service. Our total liability for any claim arising out of a booking shall not exceed the amount paid for that booking.
24. Statute of Limitations
Any claim or cause of action arising out of or related to your use of the Booksa service or these terms must be filed within one (1) year after the event giving rise to the claim, regardless of any statute or law to the contrary. Claims not filed within this period are permanently barred.
25. Changes to These Terms
We may update these terms at any time. When we do, we will revise the “Last updated” date above. Your continued use of the service after changes are posted constitutes your acceptance of the revised terms.
26. Waiver
Our failure to enforce any right or provision of these terms on any occasion shall not constitute a waiver of that right or provision or our ability to enforce it in the future.
27. Severability
If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
28. Entire Agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and SA Picture Day with respect to the Booksa service and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
29. Governing Law
These terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of Bexar County, Texas.
